Frequently Asked

Questions

What types of cases does the firm handle?

The firm focuses on cases involving serious and catastrophic injuries caused by defective products, medical malpractice, and all types of accidents. I have an additional focus on cases involving police misconduct. For a complete list, please see the Practice Areas section, above.

What about cases you don’t handle?

The field of law has become quite specialized and no one attorney handles every type of case. That said, if I don’t practice in an area that you require, most likely I know who does, and I’m more than happy to make a thoughtful referral.

Why choose a trial lawyer if I want to settle?

While most cases do settle, it is often the credible threat of a trial that drives the better settlements. And, if your case does not settle, you want someone with a proven track record of going the distance. If your case goes to trial, I won’t refer you to another lawyer you’ve never met and didn’t hire to complete the process. In fact, I am often retained as trial counsel by other lawyers when they have cases that they are unable to settle.

What are your legal fees?

The vast majority of cases that I handle are contingency fee based. That means that I do not get paid until you get paid. Also, my fee is directly tied to your recovery, so I do better when you do better. Fees are set by New York State law and, depending on the type of case, they are typically one-third of the overall recovery. All initial consultations are free, no matter what type of case you have.

How long will this take and how much will I get?

My goal is always to resolve your case as quickly as possible while securing a result second to none. If I accept your case, it is because I sincerely believe that we will prevail. That said, nobody can guarantee the outcome of your case or an exact timeline. You should be skeptical of any lawyer who tells you what you want to hear in order to get your business. There are simply too many unknown variables to make precise predictions when your case is new.

What should I do while my case is being litigated?

Communication is key. Keep a list of all medical facilities, doctors and therapists involved in your care, and any expenses you incur, and share all updates with your attorney. Further, be sure to comply with all medical directives. Whatever you do, don’t post anything about your legal situation, or anything that can damage your case to social media. Also, you should understand that you may be videotaped at any time you leave your home.

Will I have to pay taxes on my recovery?

In the vast majority of cases the answer is no. There are some exceptions, so be sure to ask your attorney if you have this concern.

Who can I trust to refer me to a good attorney?

The short answer is, another attorney, a former client, or someone you have good reason to trust. People you don’t know who hand you the business card of some lawyer you’ve never heard of, is risky business and often illegal. You should never trust a referral source that you suspect may be getting paid by some lawyer for referring you into their office. An attorney should earn your business, not buy it.

Should I trust attorney advertising?

The best way to find any professional, be it medical, legal or otherwise, is a recommendation from someone with firsthand experience. While attorney advertising may seem impressive, advertisements are always made to look good. If you don’t have a trusted referral source, it is important to do your own research, meet with the attorney, and see if you feel comfortable and confident putting your case in his or her hands.

Each referral is treated with the highest regard, reflecting my commitment to trust and excellence.

The trust placed in me by my colleagues is sincerely valued, and my relationships with other law firms tend to be quite enduring. Whether you’re looking to refer your case to a trusted advocate, or to retain counsel for an upcoming trial, I am well equipped and often selected to handle difficult cases that require a nuanced, strategic approach. I look forward to working with you to achieve the best possible outcome.
